1. About us and these Terms

These Terms govern your use of the Exploring Antigua website and your purchase and use of our products and services, including digital “Experience Passes” and future digital guides or physical merchandise (together, the Services). “Exploring Antigua” is the trading name of Exploring Global Ltd (“we”, “us”, “our”).

We publish independent reviews and curate partner offers. Unless we say otherwise, we are not the operator of the partner experiences listed on our site.

2. Using the site

You agree to use the site lawfully and not to harm its operation. You must not: scrape or copy content at scale, interfere with security, attempt unauthorised access, or upload unlawful/infringing material. We may suspend access where we reasonably suspect misuse or fraud.

3. Accounts and eligibility

You must be 18+ to purchase an Experience Pass. Passes are tied to one named user account and are non-transferable. Keep your login secure; you are responsible for activity on your account. We may suspend or terminate accounts for breach or suspected fraud.

4. What we do (and don’t do)

We are a curator/facilitator. Partners are independent providers responsible for their own services, premises, staff, safety, licensing, compliance and availability. When you redeem a perk, your experience is delivered by the Partner under their terms.

5. Prices, currency and payment

Prices are shown in US Dollars (USD) and are tax-inclusive where applicable (unless stated otherwise). We use Stripe to process payments. Your bank may apply cross-border/FX or issuer fees; these are outside our control and are not refundable by us.

6. Experience Passes: season validity and redemption rules

  • Season dates. Each Pass is valid only for the season shown on the Pass page. Passes expire at the end of the season and are not extended.
  • One-per-pass. Unless stated otherwise, each included perk/offer can be redeemed once per Pass. Buying a new Pass that also includes the same offer allows a fresh redemption under that new Pass.
  • Claim codes & expiry. When you claim an offer, we generate a unique code with an expiry window shown at claim and in your email. Expired codes cannot be reinstated.
  • Partner rules. Perks may be subject to Partner booking requirements, capacity limits, blackout dates and on-site rules. Partners may request ID matching your account name.
  • No stacking. Perks cannot be combined with other promotions, discounts or local pricing unless explicitly stated on the listing.

7. Cooling-off and refunds (digital passes)

  • Cooling-off. You have 14 days after purchase to cancel if you have not made any claim or used the Pass. Once a claim is made or access is used, the right to cancel ends.
  • Refunds. Within the 14-day period and unused, you may request a refund. After any claim/use, refunds are not available. We may offer a 48-hour goodwill refund at our discretion for genuine mistakes (unused). Your statutory rights remain unaffected.
  • Partner cancellations. If a Partner cancels (e.g., weather), resolution is via the Partner (e.g., reschedule or equivalent credit). We are not responsible for third-party cancellations.

8. Changes and availability

Partner participation can change. We may add, suspend, substitute or remove listed perks during a season to reflect Partner availability. We aim to maintain overall Pass value. We may update these Terms with notice (site banner or email); continued use after changes indicates acceptance.

9. Prohibited conduct (Passes and claims)

No resale or sharing of Passes or codes. No automated or bulk claims, manufacturing of accounts, attempts to bypass redemption limits, or other abuse. We may cancel codes and suspend accounts where we reasonably suspect misuse.

10. Editorial content (reviews and ratings)

Our reviews and ratings are opinions based on our visits and scoring framework. They are for general information, not guarantees. Experiences vary with season, staff and weather. Always confirm essential details with the venue.

11. Digital guides

Paid guides are digital content licensed for personal, non-commercial use. No copying, redistribution or resale. Cooling-off and refunds follow Section 7.

12. Physical merchandise (future)

If we sell physical goods: unless an exception applies (e.g., personalised items; hygiene-sealed goods once opened), you have 14 days from delivery to cancel and a further 14 days to return after telling us. Refunds cover the product price once received in original, resellable condition. Shipping/returns details will be shown at purchase.

13. Gift Passes and promotions (if offered)

Gift Passes and promotional codes may have their own terms (validity, transferability, expiry). Where terms conflict, the Gift/Promo terms apply.

14. Your responsibilities with Partners

You are responsible for meeting eligibility, health/safety and timing requirements set by the Partner; for bookings you make; and for following on-site instructions. We are not liable for the acts or omissions of Partners.

15. Liability and disclaimers

Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, fraud or any liability that cannot be limited by law.
To the maximum extent permitted by law:

  • we are not liable for Partner-provided services;
  • we exclude liability for indirect or consequential loss, and loss of profit, data or goodwill; and
  • our total liability to you for paid products is capped at the amount you paid to us for the Pass giving rise to the claim in the 12 months before the event.

16. Force majeure

We are not responsible for failure or delay caused by events beyond our reasonable control (including severe weather, utility failures, strikes, epidemics, natural disasters, or governmental action).

17. No partnership/agency

Nothing creates a partnership, joint venture or agency between us and any Partner. We do not accept responsibility for contracts between you and a Partner.

18. Complaints and support

If there’s an issue, contact support@exploringantigua.com. For Partner-delivered experiences, we may help facilitate communication, but the Partner is responsible for remedy where the issue relates to their service.

19. Intellectual property

The site, content, ratings framework, logos and design are owned by Exploring Global Ltd or our licensors. You may not copy, reproduce or adapt without permission. Partner images or materials are used under licence/permission and remain their property.

20. Notice & takedown

If you believe content on our site is unlawful or infringes your rights, email support@exploringantigua.com with details. We’ll review and take appropriate action.

21. Assignment

We may assign or transfer our rights and obligations under these Terms to another organisation. You may not assign your rights without our prior written consent.

22. Severability

If any provision is found unlawful or unenforceable, the remaining provisions remain in full force.

23. No waiver

Failure to enforce a right is not a waiver of that right.

24. Entire agreement

These Terms constitute the entire agreement between you and us regarding the Services, superseding any prior statements about the Services, except for mandatory consumer rights.

25. Third-party rights

No one other than you and us has rights under these Terms (Contracts (Rights of Third Parties) Act 1999 does not apply).

26. Governing law and jurisdiction

These Terms are governed by the laws of England and Wales. The courts of England and Wales have non-exclusive jurisdiction (you may have rights to bring claims where you live if mandatory law allows).
